The Supreme Court has refused the urgent listing of a plea against a Madras High Court decision allowing the Music Academy in Chennai to present an award instituted in the name of M.S. Subbulakshmi to Carnatic singer T.M. Krishna.

The Chief Justice of India Sanjiv Khanna said the petition would be listed on Monday (December 16, 2024).

Additional Solicitor General N. Venkataraman, who made the oral mentioning, said the award was scheduled to be presented on Sunday. However, the CJI responded orally that, if need be, the award could be recalled.

It may be noted that earlier in the day, a Division Bench of the Madras High Court comprising Justices S.S. Sundar and P. Dhanabal set aside an interim injunction granted by a single judge restraining the Music Academy and The Hindu from giving away a cash prize of ₹1 lakh under the title ‘Sangita Kalanidhi M.S. Subbulakshmi Award’ to Carnatic singer T.M. Krishna.

The acclaimed musician’s grandson V. Shrinivasan had filed a civil suit in the High Court in August this year against the use of his grandmother’s name for the award on the ground that she had left behind a Will stating that no memorial, of any kind, should be instituted after her death.

Observing that the word ‘memorial’ could be interpreted in different ways by different people, Justices Sundar said, even the other beneficiaries of the will such as the plaintiff’s sister or mother might approach the court anytime and claim quite contrary to what he was claiming.
